Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Custody

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her ruling.

The situation stems from a erroneous removal to El Salvador in March, which the government later admitted was an error. Following his return to the United States to face alien smuggling charges, he was held in federal detention.

In her order, the court noted that the authorities does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

Context of the Case

The legal challenge involve disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing criminal case in Tennessee.

The judge, who was hearing his challenge to removal in a federal court, determined that he must now adhere to the terms of his release from custody in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
